Up till now most of us were able to get some sort of malpractice insurance, but now the company that we were using notified us that they are not renewing our insurance. We are looking for another option and while the ministry of health has written in it's guidelines that we should have insurance, they are doing nothing to help us get insurance. We are working on this problem with the help of a lawyer but it is a worldwide problem for independent home midwifery. We are a small pool of midwives and the insurance companies just don't want to deal with us as it is not profitable for them. Now, couples wanting a homebirth will have to sign a consent form that they are aware of this and obligate themselves not to sue the midwife in the case of a bad outcome from a homebirth. This is to protect the midwife and her family from being sued and her losing all her property and legal fees etc. Obviously, no midwife wants a bad outcome and we all try our best, but bad outcomes can happen rarely at home as they do in the hospital.
